Terms of Service

1. Acceptance of Terms

By using PassportPic.ai (the “Service”), you agree to these Terms of Service. If you do not agree, please do not use the Service. These Terms form a binding contract between you and PassportPic.ai.

2. Description of Service

PassportPic.ai is a web tool that helps users create photos intended to meet the published specifications for passports, visas, IDs, and similar documents. The Service:

• Processes photos entirely in your browser (client-side).
• Checks images against published country specifications.
• Provides digital and print-ready output files.

3. No Guarantee of Acceptance

We design our compliance checks to follow the specifications published by the relevant issuing authorities. We do not guarantee that any specific government office, embassy, or other authority will accept a photo produced by the Service. Final acceptance is at the sole discretion of the issuing authority. We are not affiliated with, endorsed by, or certified by any government, exam provider, or other third-party organisation referenced on this Service.

4. User Responsibilities

You are responsible for:

• Providing a clear, well-lit photo that meets basic quality standards.
• Selecting the correct country and document type.
• Following any additional or updated requirements from the issuing authority.
• Verifying the final photo meets your needs before submission.

5. Pricing and Refunds

The Service is priced at $4.99 per photo (one-time, no subscription). Payments are processed by Lemon Squeezy as merchant of record. During the initial launch period, payment collection may not yet be enabled — when it is, this section will reflect the active pricing in effect.

Unlimited retakes:you can run and re-run the Service as many times as you like before you pay — the one-time fee is charged only when you choose to keep a result you’re satisfied with.

Refunds (paid plans):

• You can preview the result and your compliance report before paying.
• If your photo is rejected by the issuing authority and you provide reasonable evidence of the rejection, we will refund your purchase in full or, at your choice, regenerate the photo at no charge.
• Outside of the case above, sales are final once you have downloaded your files.
• We may grant additional refunds at our discretion for technical issues with the Service.

6. Intellectual Property

You retain full ownership of your photos. We claim no rights in your images. You may use any photo generated by the Service for any lawful purpose. The Service itself, including its software, design, and content, is owned by us and licensed to you on a limited, non-exclusive, non-transferable basis for personal use.

7. Acceptable Use

You may not use the Service to:

• Create fraudulent, forged, or misleading identification documents.
• Violate any applicable law or regulation.
• Impersonate another person or misrepresent your identity.
• Abuse, harass, or harm others.
• Attempt to reverse engineer, decompile, or extract the source code of the Service beyond what applicable law allows.
• Interfere with the operation of the Service or its security features.

8. Disclaimers and Limitation of Liability

The Service is provided “as is” and “as available”without warranties of any kind, whether express, implied, statutory, or otherwise, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, or that the Service will be error-free or uninterrupted.

To the maximum extent permitted by law, PassportPic.ai is not liable for:

• Rejection of photos by any government authority, exam provider, or other organisation.
• Missed deadlines, travel disruptions, or visa-application failures.
• Indirect, incidental, special, consequential, exemplary, or punitive damages.
• Loss of profits, revenue, data, or goodwill.

Our total aggregate liability for any claim arising out of or relating to the Service is limited to the greater of (a) the amount you paid us in the 12 months preceding the claim, or (b) US$50.

9. Indemnification

You agree to indemnify and hold harmless PassportPic.ai from any claim, loss, or expense (including reasonable legal fees) arising from your misuse of the Service, your violation of these Terms, or your violation of any applicable law or third-party right.

10. Third-Party Trademarks

References to country names, exam names (such as TOEFL, GRE, GMAT, IELTS, PTE, SAT, LSAT, MCAT, PMP, CFA), and document types are made for descriptive purposes only. All trademarks, service marks, and trade names are the property of their respective owners. PassportPic.ai is not affiliated with, endorsed by, sponsored by, or certified by any of these organisations.

11. Disputes — Talk to Us First

If you have a concern or complaint about the Service, please email us at [email protected] before taking any other action. Most issues are resolved quickly and at no cost when we hear about them directly. We will respond to good-faith requests as soon as we reasonably can, and in any event within 30 days.

Nothing in these Terms limits any mandatory consumer-protection rights you have under the laws of your country of residence. EU and UK consumers, for example, retain all rights granted by their local consumer law regardless of any other provision in these Terms.

12. Termination

We may suspend or terminate your access to the Service at any time, without notice, if we believe you have violated these Terms or applicable law. Sections 6 through 13 survive termination.

13. General

• Severability: if any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in full force and effect.
• No waiver: failure to enforce any provision is not a waiver of our right to enforce it later.
• Assignment: you may not assign these Terms without our prior written consent. We may assign them in connection with a merger, acquisition, or sale of assets.
• Force majeure: we are not liable for delays or failures caused by events beyond our reasonable control.
• Entire agreement: these Terms, together with our Privacy Policy, are the entire agreement between you and us regarding the Service.

14. Changes to These Terms

We may update these Terms from time to time. Material changes will be highlighted on this page. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
